Jenny Kwan is closing Canada’s “arms embargo loophole” that allows Canadian arms to flow through the US without accountability. Currently, Canadian weapons can reach global conflicts, contributing to human rights abuses despite international law.

Her Private Member’s Bill strengthens monitoring and disclosure standards to prevent Canadian arms from being used in war crimes or harming civilians. This legislation reflects Canada’s commitment to peace, justice, and human rights, including situations of impunity such as in Gaza being perpetrated by Israel.

Canada Must Not Be Complicit in War and Repression

Right now, loopholes in Canada’s arms export laws allow Canadian-made weapons and components to end up in the hands of governments accused of war crimes and human rights abuses.

That’s wrong.

On September 19th, Jenny introduced a Private Member’s Bill in Parliament to close these dangerous loopholes and make sure Canadian weapons are never used to harm civilians or fuel repression abroad. There will be a vote in Parliament in February 2026. We need your help to mobilize your friends and neighbours!

The Problem

When Canada joined the Arms Trade Treaty in 2019, it left out one big exception — exports to the United States.

The U.S. is the largest buyer of Canadian military goods. Once there, those Canadian-made parts can be built into weapons systems and shipped to countries accused of bombing civilians or violating human rights — with no transparency, no accountability, and no oversight.

Reports from Amnesty International and Arms Embargo Now have shown that Canadian components have been used in conflicts like Gaza and Yemen.

This must stop.

What Jenny’s Bill Will Do

✅ Apply export controls to all arms, parts, and technology — no exceptions.
 Remove exemptions for the U.S. and other countries.
 Ban blanket export permits for weapons and munitions.
 Require end-use certificates to prevent diversion to human rights abusers.
 Mandate annual public reports to Parliament on Canada’s compliance with the Arms Trade Treaty.

Bill C-233, the No More Loopholes Act, is a private member’s bill put forward by Vancouver-East MP Jenny Kwan in September 2025 to press Canada to abide by the Arms Trade Treaty that it signed in 2019. Currently arms exported to the US are exempted and have ended up being used by Israel in Gaza, by Saudia Arabia in Yemen and many other places. The private member’s bill will be voted on in Parliament at Second Reading in late-February.

For two years, the Liberal government has allowed arms manufacturers based in Canada to profit off genocide by sneaking unregulated and unreported weapons parts to Israel through the US.

This has been possible because of a giant loophole in our export laws. When Canada updated our laws in 2019 to align with the Arms Trade Treaty, the Liberals intentionally left the US loophole open, and corporations have exploited this weakness to maintain military trade with Israel, a genocidal state.

Now those same weapons are threatening the people of Palestine, Venezuela, Iran, Greenland, and eventually could end up trained back on us here at home.

That’s why we have partnered with MP Jenny Kwan to close the US loophole using her Private Member’s Bill C-233, the No More Loopholes Act.

Our bill has the government scared, because it exposes their hypocrisy and refusal to take meaningful action.

Prime Minister Mark Carney talks about pragmatic principles, but Canada’s weapons exports to the United States tell a different story.

This sitting, Parliament will vote on the No More Loopholes Act, a private member’s bill introduced by NDP MP Jenny Kwan. The legislation would tighten up our arms export processes, and finally require American-bound arms to be regulated the same way as all other Canadian military exports, subjecting them to transparency requirements and human rights risk assessments.

Carney has insisted that Canada must apply consistent standards and lead with its values. This is a true test of that claim.

If this country is serious that our way forward must and will be “principled and pragmatic” then the path we must walk is clear: close the U.S. arms export loophole. Subject all Canadian weapons exports to the same scrutiny. And stop pretending that selectivity is a form of principled foreign policy.

This is where the rubber hits the road. Will Prime Minister Carney contend with the world as it is, with principles at the fore? Or will he continue to capitulate to hegemons and arm their atrocities?

Another form of pressure on the F-35 supply chain has been at a national level. In March 2024, after months of organizing and pressure, Canada’s House of Commons passed a non-binding motion that officially called on the Government of Canada to “cease the further authorization and transfer of arms exports to Israel.” Following this motion, then foreign affairs minister Mélanie Joly confirmed that the government would halt future arms sales to Israel.

Though that assertion was a positive step, there are still many loopholes, as detailed by Project Ploughshares. In particular, as with the parts of the F-35 aircraft, Canada continues to indirectly arm Israel by exporting to the United States.

This is one of the loopholes that NDP MP Jenny Kwan (Vancouver East) has been targeting through a Private Member’s Bill in the House of Commons. The reaction from the Liberal party has been unsurprisingly negative, and the NDP lacks the seats in Parliament to force the government to comply. Yet, this Bill represents one way people around the country can exert some influence, by calling upon their Members of Parliament to support this effort.

The F-35 is a force for destruction. It is responsible not just for the devastating situation in Palestine but also, most recently, the attack on Venezuela that led to the abduction of President Nicolas Madura also featured F-35 aircraft. Canadians should try to do what they can to obstruct the production of this destructive weapon.

Canada and 13 other countries issued a joint statement Wednesday condemning the Israeli security cabinet's approval of 19 new settlements in the occupied West Bank.

“We recall that such unilateral actions, as part of a wider intensification of the settlement policies in the West Bank, not only violate international law but also risk fueling instability,” the joint statement says.

On Sunday, Israel's cabinet announced the approval of 19 more settlements, bringing the number of new settlements over the past few years to 69, according to Israeli Finance Minister Bezalel Smotrich, who has pushed an expansion agenda in the West Bank.

The approval increases the number of settlements in the West Bank by nearly 50 per cent during the current far-right government’s tenure. In 2022, there were 141 across the West Bank. Now, there are 210, according to Peace Now, an anti-settlement watchdog group.

Settlements are widely considered illegal under international law. Smotrich’s office said the cabinet approval came on Dec. 11 and that the development had been classified until Sunday.

On Monday, Foreign Affairs Minister Anita Anand condemned the news in a post on X.

“The continued settlement expansion is contrary to international law and puts at risk the 20 Point Peace Plan. Clearly such action undermines the prospects for a two-state solution and the ultimate objective of Israelis and Palestinians living side by side in peace and security,” said Anand.

OTTAWA — Two MPs from a delegation that was denied access to the West Bank earlier this week are asking Foreign Affairs Minister Anita Anand to get Israel to explain the harsh treatment of one of their colleagues.

Several witnesses told The Canadian Press they saw Israeli border officials push Ontario Liberal MP Iqra Khalid while the approximately 30-person delegation was held up at the Allenby Crossing for several hours on Tuesday.

In a letter sent to Anand late Thursday, NDP MP Jenny Kwan and Liberal MP Gurbux Saini — also members of the delegation — called that behaviour “an egregious violation of personal dignity and basic diplomatic norms.”

The MPs also attached a copy of a form they allege some delegation members were pushed to sign under duress.

Six Canadian MPs were denied entry to the West Bank on Tuesday by Israeli authorities, prompting Foreign Affairs Minister Anita Anand to publicly voice her disapproval of their treatment.

The NDP and Liberal MPs, part of a delegation of about 30 Canadians on a fact-finding visit, were prevented from entering the West Bank at the Israeli border crossing with Jordan.

Ottawa had given Israeli officials prior notification of the visit, and the MPs’ electronic travel authorizations had been approved, according to Jenny Kwan, an NDP MP who was part of the visiting group.

Ms. Anand said Canada has raised its objections with Israel about the treatment of the group.

“These are parliamentarians who were simply seeking to visit in a professional way, and my understanding is that denying their entry, with that objective in mind, is not in keeping with the bilateral relationship that we have shared with Israel over the course of a number of decades,” she said in an interview.

Ms. Kwan issued a statement saying: “Electronic travel authorizations to enter the West Bank were initially approved but were subsequently revoked on the day of our arrival. Israeli authorities cited ‘public security, public safety, or public order considerations’ as the basis for the denial.”

She said that during the trip to Jordan there had been meetings with Palestinians as well as the Canadian ambassador there. The delegation also met families living in refugee camps and with organizations delivering humanitarian assistance.

“I categorically reject the assertion that elected officials and civil society organizations engaging in humanitarian and fact-finding work pose any risk to public safety, security, or public order,” she added.

Ms. Kwan said the trip was organized to deepen delegates’ understanding by speaking to Muslim, Jewish and Christian families about their experiences.

“The use of security and public order narratives to limit legitimate fact-finding work is completely unacceptable,” she said.
